crewser SMS Consent Requirements

crewser is operated by Cinework Software GmbH.

crewser is a crew management and time-tracking platform for film and television productions. Production companies may use crewser to send transactional SMS messages to crew members, including project invitation links, secure access/login links, time-tracking reminders, and timesheet submission reminders.

How SMS Consent Is Collected

Crew members do not opt in to SMS through a public crewser-hosted signup form before receiving the first invitation message. Instead, SMS consent is collected by the production company outside crewser as part of the crew onboarding process, such as in a deal memo, project agreement, onboarding form, start paperwork, electronic contract, or equivalent written/electronic production document.

Before a production company may request an SMS invitation through crewser, the production company must obtain the crew member's consent to receive transactional SMS messages from crewser. The consent language must be shown to the crew member before the first SMS is sent.

Consent must be voluntary, informed, demonstrable, and project-specific. The production company should document in particular when consent was given, which consent text was used, for which project it was given, and for which mobile phone number.

For recipients in Germany, the production company must also ensure that SMS messages containing advertising content are sent only with prior express consent under German law, in particular Section 7 of the German Act Against Unfair Competition (UWG). crewser SMS messages under this program must not be used for advertising, newsletters, cross-selling, or other marketing purposes.

Required Crew-Facing SMS Consent Language

The SMS consent language should be placed next to the mobile phone number field or included in the crew member's project agreement, deal memo, onboarding paperwork, start paperwork, or electronic contract.

Production Company Responsibilities

Production companies using crewser must not request an SMS invitation for a crew member unless that crew member has provided SMS consent using the required language above or substantially equivalent language approved by crewser.

Production companies may add crew members to their crewser project list without sending an SMS invitation. However, crewser SMS invitations are used to deliver secure access links for crew members who have consented to receive transactional SMS messages from crewser. A production company must not request an SMS invitation for a crew member unless that crew member has first provided consent to receive transactional SMS messages from crewser.

Production admins accept crewser's Terms when signing up for crewser. The Terms require production companies and their admins to collect crew member SMS consent outside crewser before requesting SMS invitations. Admin acceptance of crewser's Terms is not the crew member's SMS opt-in.

The production company is responsible for ensuring that the consent collected complies with the laws applicable to the relevant recipients. For projects involving recipients in Germany, this includes clearly separating transactional project SMS from advertising SMS that would require separate marketing consent.

SMS Program Details

Because SMS consent is collected outside crewser, the production company is responsible for documenting that consent and being able to provide proof if needed.

crewser SMS messages are transactional and relate to project access, onboarding, time tracking, and timesheet submission. crewser does not use this SMS program to send marketing or promotional messages.

Crew members can opt out of crewser SMS messages at any time by contacting support@crewser.app. Each crewser SMS message contains a corresponding unsubscribe notice.

After an opt-out, no further crewser SMS messages may be sent to the affected mobile phone number under the relevant SMS program, except where technically or legally necessary to confirm the unsubscribe, prevent abuse, or comply with legal obligations.
